The port planning instruments are the Director, the Utilization and the Special.
The Balearic Islands Port Authority (APB) informed the Palma City Council that "general plans and other general instruments of urban planning must classify the service area of state ports as a general port system and may not include
determinations that imply an interference or disturbance in the exercise of port operation powers."
Coinciding with the public consultation phase of the basic planning guidelines document for the revision of Palma's General Urban Development Plan (PGOU), the Port Authority of the Balearic Islands (APB) sent a letter to the Palma City Council in December 2013 alleging
that the text prepared by the council "includes provisions that interfere with or disrupt the exercise of port operation powers, as it mentions the recovery for the city of the Paseo de La Riba, the Old Wharf, and the Camino de la Escollera. These areas cannot be recovered for the city," the APB letter continues, "since they never belonged to the city, and they
were created and reclaimed from the sea by what is now the Port Authority, then under a different name, and have always been a Service Area of the Port of Palma de Mallorca."
The APB reminds the council that the port planning instruments are the Special Plan, definitively approved by the Palma City Council on January 30, 1997, the Port Space Utilization Plan (PUEP), approved by the Ministry of Public Works by Ministerial Order of May 19, 2005 and the Infrastructure Master Plan, in the preparation phase and pending processing.
